ELECTION PETITIONS - ELECTORAL OFFENCES: The requirements that must be satisfied where electoral offences such as thuggery; violence; bribery; multiple thump printing are made in election petition
"The testimonies of PW1 -Pw4 were, inextricably, woven around criminal allegations: allegations such as thuggery; violence; bribery; multiple thump printing: criminal intimidation etc are all well defined offences under the Electoral Act, see, for example, sections 120; 124; 129; 130 and 131 thereof. There can be gainsaying that such offences must be proved beyond reasonable doubt. Two instances may be taken from case law in further elaboration of the point being made. Judicial opinions have been fairly consistent that bribery at an election is an offence which must be proved beyond reasonable doubt.
