ADMISSIBILITY OF UNREGISTERED REGISTRABLE INSTRUMENT: Position of the law as regards the admissibility of an unregistered registrable instrument

"A registrable instrument though unregistered is admissible in evidence in order to prove equitable interest. See the decision of this Court in Sankey vs. Onayifeke (2013) LPELR - 21997 CA page 38. Exhibit 8 is admissible in evidence in order to prove equitable interest. I do not agree with learned counsel for the Appellant that it should be expunged from the record.

Learned counsel for the Appellant also urged the Court to expunge Exhibits 9, 10, 11, 12(a) and 12(b) because they are registrable instruments by virtue of Sections 2 and 15 of the Land Registration Law. On the authority of Sankey vs. Onayifeke just cited, these documents were rightly admitted and should not be expunged from the records."
