"It is pertinent to state at this point that contrary to the submission of the respondents' counsel, the evidence of CW4 - Mrs. Adejare Ajayi - was not hearsay evidence as she testified as the Chief Executive of the appellant company. A company being a juristic or artificial person can only act through its agent, servant, and any agent, servant or official of a company can therefore give evidence to establish any transaction entered into by the company even though he did not personally take part in the transaction on behalf of the company. The fact that such an agent, servant or official of the company did not personally participate in the transaction on which he has testified only goes to the weight to be attached to such evidence.
