. EVALUATION OF EVIDENCE: Duty of trial judge to evaluate evidence and the procedure for evaluation of evidence
"It is the primary duty of the trial Court to evaluate and ascribe probative value to the evidence adduced. The complaint of the Appellant is that the evidence was not properly evaluated. From the authorities, evaluation of evidence is basically the assessment of the facts by the trial Court to ascertain which of the parties to a case before it has more preponderant evidence to sustain his claim.
