"Trespass to land is rooted in the right to exclusive possession. Trespass to land is actionable at the instance of the person in possession. See Okoko vs. Dakolo (2006) 14 NWLR (Pt. 1000) 401. There is overwhelming evidence that the Respondents' family has been in exclusive possession of the land since 1885. Therefore the invasion of the land by the 2nd Appellant with thugs in 2004 is actionable at the instance of the Respondents."
