Wabara&ors v Nnadede&ors (2009) LPELR -4247 CA

FUNDAMENTAL HUMAN RIGHT: Whether any person who feels his fundamental human rights have been infringed is at liberty to institute an action in the High Court

"The law is that once the Governor has exercised powers of recognition under section 9 of the Abia State Edict No. 8 1991, any person who feels his rights have been infringed is at liberty to take action in the High Court, which in exercise of its jurisdiction under section 272(1) of the Constitution, is empowered to entertain same. This is a confirmation of' the right of an aggrieved citizen to go to court against a fellow citizen and or Government after his right has been infringed.
