"My lords, please permit me to stress or emphasise that "Fair hearing" in essence, means giving equal opportunity to the parties to be heard in the litigation before the court. Where the parties are given opportunity to be heard any of them that abuses such opportunity for instance by not presenting his case or by absenting himself, he cannot complain of breach of fair hearing principles. See Independent National Electoral Commission v Alhaji Abdulkadir Balarabe Musa (2003) LPELR-24927 (SC)". -
