"It is apposite to state that Agency relationship also creates a fiduciary obligation either expressly, impliedly or by operation of law. It is the law, that the status of a party under an agency relationship is often largely determined, in the absence of any express agreement, by the intention of the parties involved: See: Cotena Int’l Ltd V Churchgate Nig Ltd & Anor (2010) 18 NWLR (Pt 1225) 346. Agency relationships may be impliedly created by reasonable deductions that could be made from the conduct of both parties in relation to the transactions involved".
